Use of the Bot

1.1 By using Kyle, the bump bot developed by Foxems#6719, you acknowledge and agree that the bot is provided as-is, and its uninterrupted or error-free operation is not guaranteed.

1.2 You acknowledge and agree that copying, reproducing, or replicating any of the banners or visual assets used by Kyle, developed by Foxems#6719, is strictly prohibited and may result in a violation of copyright laws and Discord's Terms of Service.

1.2 You are granted permission to use Kyle solely for its intended purpose and in compliance with Discord's Terms of Service and Community Guidelines.

1.3 You must not utilize Kyle for any illegal activities, violate any applicable laws or regulations, or misuse commands, such as "say," "embed," or others, with the intent to damage Kyle or spread misinformation about Kyle. Such actions may lead to reporting, inclusion in a database, and blacklisting from using Kyle in any way.

1.4 You are strictly prohibited from using Kyle to propagate NSFW (Not Safe for Work) content or engage in any activities that may result in permanent blacklisting.

1.5 Foxems#6719 or Kyle Managment davidczeq#2175 / davidczekk#7533. reserves the right to modify, suspend, or terminate Kyle's functionalities or access to the bot at any time without prior notice.

1.6 Abusing in any way our other bot called "Kyle - Artificial Intelligence" can lead to a blacklist on all the things we do. Abuse is defined as any misuse of KyleAI for spamming, running illegal discussions and other things that also violate the Discord ToS.

1.7 Refunds: Premium functions offered by Kyle are non-refundable. Once a user has paid for premium features, no refunds will be provided, regardless of the circumstances.

1.8 Blacklisting: Premium functions do not provide immunity against blacklisting. Users engaging in prohibited activities or violating the Terms of Service may still be subject to blacklisting from using Kyle.

1.9 Future Changes: By purchasing premium features, you acknowledge and agree that Foxems#6719 reserves the right to modify, suspend, or terminate premium features or access to them at any time without prior notice. You understand that every feature is subject to change or deletion, and Foxems#6719 or Kyle Management shall not be held liable for any losses or damages resulting from such modifications or terminations.

Data Collection and Privacy

2.1 Kyle may collect and store certain user data, including but not limited to user IDs, server IDs, and message content, solely for the purpose of providing its functionalities.

2.2 Foxems#6719 will not share or sell any user data collected by Kyle to third parties unless required by law or to comply with legal processes.

2.3 While reasonable measures are taken to protect user data, Foxems#6719 cannot guarantee absolute security. By using Kyle, you acknowledge and accept the inherent risks of data transmission over the internet.

Limitation of Liability

3.1 Foxems#6719 shall not be held liable for any direct, indirect, incidental, special, or consequential damages arising out of or in connection with the use or inability to use Kyle.

3.2 Foxems#6719 shall not be responsible for any damages caused by the actions or behaviors of Kyle's users or any other third parties.

Intellectual Property and Usage Restrictions

4.1 All intellectual property rights related to Kyle, including but not limited to copyrights, trademarks owned by Foxems#6719.

4.2 You may not copy, modify, distribute, or sell any part of Kyle without the express written permission of Foxems#6719.

Governing Law and Jurisdiction

5.1 These Terms shall be governed by and construed in accordance with the laws of the Czech Republic.

5.2 Any legal actions or proceedings arising out of or in connection with these Terms shall be exclusively brought in the courts of the Czech Republic.

Modifications to the Terms

6.1 Foxems#6719 reserves the right to modify or update these Terms at any time without prior notice. It is your responsibility to review these Terms periodically for any changes.
